Terms of Service

Introduction

The website www.masterlife.coach (the “Site”) is owned and operated by OzAvenue Consulting Services Pty Ltd, an Australian-based entity (referred to as “we”, “us” or “MasterLife”). By accessing or using this Site, you, as a visitor and/or user, agree to these Terms of Service (as amended or modified from time to time), and your use of the Site constitutes your acceptance of these terms. These Terms apply to your use of the Site, participation in MasterLife programs, purchase or access of digital products, community interactions, and all related Services. These Terms of Service also govern your participation in any MasterLife online programs, private community spaces (including Facebook), and any communications delivered through third-party platforms such as WhatsApp or messaging services used to support your Program. Your use of the Site, participation in MasterLife programs, purchase or access of digital products, interaction in community spaces, and any information you provide to us are subject to these Terms of Service, with an effective date of 18 November 2025.

By clicking the “I accept” button or by using the Site or Services, you acknowledge that you are 18 years of age or older (or of legal age in your jurisdiction required to form a binding contract if that age is over 18), and that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service, you must not access or use the Site or Services. MasterLife may modify these Terms of Service at any time, at our discretion. Such modifications take effect when posted on the Site or when we otherwise notify you. Your continued use of the Site or Services constitutes acceptance of any updated Terms of Service.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under the Australian Consumer Law or any similar law that cannot lawfully be excluded or limited.

Some educational content provided through the Site or Services may be partially generated or supported by automated systems, including artificial intelligence tools. This content is for general information only and is not a substitute for personalised professional advice.

PLEASE READ THE FOLLOWING CAREFULLY BEFORE YOU USE OUR SERVICES.

Who can use our site or services

Our Site and Services are not intended for use by individuals under the age of 18 (a “Minor”) unless a Minor has obtained prior consent from a parent or legal guardian. Use of the Site or Services by a Minor without such consent is strictly prohibited. MasterLife is not responsible for verifying age or legal capacity, and will not be liable for any use of the Site or Services by a Minor.

If a Minor accesses the Site or Services with the consent of a parent or legal guardian, that parent or guardian is fully responsible for the Minor’s use of the Site or Services, including all purchases, communications, and any actions taken within MasterLife programs or community spaces.

Our Services

When you register for one of our MasterLife programs (Group or 1-to-1), you will receive either a structured program (three-month or six-month) or a customised program (renewable every three months). You will be able to connect with one of our Coaches, who will provide general lifestyle education and guidance based on the information you choose to share with us. Our Coaches are not doctors, dietitians, nutritionists, psychologists or other regulated health professionals, and they do not provide medical, therapeutic or diagnostic services.

MasterLife does not provide medical nutrition therapy, clinical nutrition services, psychological counselling, mental health treatment, physiotherapy services, or any form of diagnosis, prescription, or medical monitoring. MasterLife is not a telehealth provider, and our Services must not be interpreted as clinical care or an alternative to in-person medical supervision.

Access to program content is available for the duration of your program (currently 12 weeks, plus a one-week grace period unless otherwise stated). Access to private community spaces, such as a Facebook group, is available for six (6) months from your program start date. All live coaching sessions (Group and 1-to-1) are recorded by MasterLife for program delivery and internal quality purposes. Recording access differs depending on the type of session:

Group Coaching Sessions:
Video recordings of Group coaching sessions will be provided to Clients enrolled in the Program. Access is for personal use only and must not be shared, downloaded, or distributed.

One-to-One Coaching Sessions:
Recordings of 1-to-1 sessions are not shared with Clients. If a Client attends their scheduled 1-to-1 session, MasterLife will provide a written summary of the session as part of the Program deliverables.
If a Client does not attend a scheduled 1-to-1 session, no summary or recording will be provided, and the session will be forfeited in accordance with the Program’s rescheduling and attendance policies.

MasterLife may update or modify Program content, materials, schedules, or Coaches at any time. Such changes do not reduce the value of the Program and do not entitle you to a refund.

MasterLife may moderate or remove posts, comments, or Clients from private community spaces at its discretion if behaviour is inappropriate, harmful, misleading, abusive, or violates these Terms. Removal from a community space does not entitle you to a refund.

MasterLife also offers MasterLife Guides for sale or free download. These digital products contain general nutrition and lifestyle information developed by the MasterLife team. Once a digital product has been delivered to you electronically, it is deemed accessed and, subject to your rights under the Australian Consumer Law, is not eligible for a change-of-mind refund.

Some elements of the Services may be delivered through third-party messaging platforms such as WhatsApp. These platforms are not secure clinical environments and are not designed for the transmission of sensitive health information. WhatsApp messages are not monitored continuously, and MasterLife does not provide crisis or emergency support.

Payment

You agree to pay, and you authorize MasterLife’s third-party payment processor to charge, your selected payment method and payment plan for all applicable fees, instalments, and taxes that may accrue in connection with your use of our Services or purchase of our products. All fees are in US Dollars and will be charged in that currency, regardless of your location. To the extent permitted by law, and subject always to your rights under the Australian Consumer Law, all fees are non-refundable once paid. Where fees for a specific Program or product are listed in another currency, that currency will apply for that Program or product only.

All prices, discounts and promotions posted on the Site are subject to change without notice. The price charged for a product or Service will be the price advertised at the time your order is placed, subject to any applicable promotions. Pricing will be clearly stated in your order confirmation email. For subscription offerings, MasterLife may change pricing upon notice. Posted prices are inclusive of applicable taxes. MasterLife is not responsible for charges or foreign exchange rates applied by your credit card company or financial institution.

You are responsible for providing complete and accurate billing and contact information. We may suspend or terminate your access to the Services if fees are seven (7) days past due. If a payment fails, you authorize MasterLife to automatically retry the charge using the same payment method. If payment cannot be collected after multiple attempts, MasterLife may refer the outstanding amount to debt collection services, to the extent permitted by law.

MasterLife may offer the option to pay for a Program over three or six consecutive months or offer an introductory period during which no payments are due. If you select such a payment plan, you agree that you are committing to pay the full Program fee. Payment plans are not subscriptions and cannot be cancelled for convenience. Instalments must be paid in full and on time, even if you complete or discontinue the Program before the payment schedule ends, except where a cancellation or refund is required by law.

Initiating a chargeback with your bank or payment provider for fees legitimately incurred under these Terms is considered a breach of these Terms of Service. If you initiate a chargeback, MasterLife reserves the right to suspend access to all Services and pursue recovery of the outstanding amount, including any associated fees charged by our payment processor. This does not limit any rights you may have under the Australian Consumer Law.

Nothing in this section excludes, restricts or modifies any consumer guarantees, rights or remedies available to you under the Australian Consumer Law.

Content rights and Ownership

All content provided or otherwise made available by MasterLife through the Services or the Site—including text, graphics, images, audio, video, software, concepts, methods, designs, and other materials (the “Content”) is owned, controlled or licensed by MasterLife and is protected by intellectual property and unfair competition laws within and outside Australia. “Content” also includes any content that Clients (including you) provide or make available through the Services or Site (“Client Content”).

Subject to your compliance with these Terms of Service, MasterLife grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, view, copy and display the Content solely for your personal, non-commercial use in connection with the Services.

You must not reproduce, distribute, publicly display, sell, license, teach, modify, or create derivative works based on the MasterLife Programs, MasterLife Guides, or any other Content, whether in whole or in part, without our prior written consent. You must not screenshot, screen record, audio record, redistribute, share, publish, or otherwise make available any part of the MasterLife Programs, written summaries, call recordings, WhatsApp communications, or community content without our express written consent.

You retain ownership of your Client Content. By submitting Client Content, you grant MasterLife a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, adapt and distribute that content for the purpose of providing the Services. This license is solely for the purpose of operating, improving, and providing the Services to you.

MasterLife will not use Client Content for any public-facing purpose (including marketing) without your express written permission, except for anonymised or aggregated data used to improve the Services.

Any user reviews submitted to MasterLife’s website or through third-party review platforms may be used for marketing purposes.

All MasterLife frameworks, program structures, assessment tools, lesson scripts, methodologies, techniques, and AI-supported educational materials are proprietary. You may not use, replicate, adapt, translate, or incorporate these materials into any commercial or educational program without MasterLife’s prior written consent.

Trademarks and Trade names

All trademarks, service marks, trade names, logos, and graphics (“Marks”) used in the Services or on the Site are the registered or common-law trademarks of MasterLife. You may not use any Marks without the prior written consent of MasterLife.

You agree not to use any MasterLife Marks or create any names, domains, social media accounts, programs, or materials that may cause confusion, imply affiliation, or imitate the MasterLife brand.

Feedback

We at MasterLife welcome any feedback, comments, and suggestions you may have to improve our Services and/or our Site (“Feedback”). You can submit Feedback by emailing us at [email protected]. When you submit Feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully paid, royalty-free, sub-licensable and transferable license (under any intellectual property rights you own or control) to use, copy, modify, create derivative works from, and otherwise exploit the Feedback for any purpose.

Providing Feedback is voluntary, and MasterLife is not obligated to review, act on, or respond to any Feedback submitted.

No Professional or Medical Advice; No Doctor-Patient relationship

OUR COACHES ARE NOT HEALTHCARE PROFESSIONALS. OUR SERVICES AND THIS SITE DO NOT PROVIDE OR OFFER, AND ARE NOT A REPLACEMENT FOR, PROFESSIONAL MEDICAL EVALUATION, ADVICE, DIAGNOSIS, OR TREATMENT (“MEDICAL ADVICE”). MasterLife provides the Services for informational and educational purposes only. Based on information you request or provide, MasterLife may offer: (i) access to general health education and information; (ii) general lifestyle, nutrition, and fitness guidance from our Coaches; and (iii) references to external resources. While MasterLife believes the information provided is current and reliable, we cannot guarantee its accuracy, completeness or applicability.

Our Coaches do not provide therapy, counselling, psychological treatment, mental health services, medical treatment, clinical nutrition services, or any regulated healthcare service. MasterLife Coaches do not interpret laboratory results, diagnose conditions, recommend or adjust medications, prescribe supplements, or advise on therapeutic supplement dosages. Any discussion of supplements within the Program is general wellness information only.

YOU AGREE THAT BEFORE USING OUR SERVICES, YOU WILL CONSULT YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROFESSIONAL FOR MEDICAL ADVICE, PARTICULARLY IF YOU HAVE ANY MEDICAL CONDITION OR RISK FACTORS THAT MAY MAKE CHANGES TO DIET, SUPPLEMENTS, EXERCISE, STRESS MANAGEMENT OR LIFESTYLE UNSAFE OR INAPPROPRIATE. Our Services are not intended for Minors or for individuals for whom the suggested lifestyle changes may be unsuitable.

You are solely responsible for determining whether any guidance provided through the Services is suitable for you, monitoring your own health condition, and seeking prompt medical attention if you experience adverse effects.

MasterLife does not provide emergency, crisis, or after-hours support of any kind. If you experience severe symptoms, distress, or a medical emergency, you must contact your physician or local emergency services immediately.

Participation in a MasterLife Program does not create a doctor–patient, dietitian–client, psychologist–client, or any other regulated healthcare relationship, and must not be interpreted as telehealth or clinical care.

MasterLife has no obligation to monitor your health status or contact any medical or emergency professional. MasterLife is not liable for any reliance you place on information obtained through the Services or the Site, except for liability that cannot be excluded under applicable law. This disclaimer does not apply to damages caused solely by MasterLife’s gross negligence or wilful misconduct.

Results depend on individual circumstances, including health status, lifestyle factors, and adherence to Program recommendations. MasterLife makes no guarantee of weight loss, fat loss, symptom reduction, or any specific health-related change.

Assumption of Risk and Disclaimer

To the maximum extent permitted by law, MasterLife provides the Services, this Site, and any materials made available to you “as is” and “as available”. MasterLife disclaims all warranties, express, implied, statutory, or otherwise, including any implied warranties of non-infringement, merchantability, or fitness for a particular purpose. Nothing in this section excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under the Australian Consumer Law or any similar law that cannot lawfully be excluded.

MasterLife does not warrant that:
(i) your use of the Services or the Site will be uninterrupted, secure, error-free, or meet your requirements;
(ii) defects or errors will be corrected; or
(iii) the information provided through the Services or the Site is accurate, current, or complete.
We may modify or discontinue access to the Services or the Site at any time without notice. Statements or actions by customer service or MasterLife representatives do not alter this disclaimer or these Terms of Service.

Using the Services may involve risks of physical or mental injury or illness. Risks vary between individuals and may range from minor effects to more serious health impacts. You voluntarily assume all such risks.

Risks associated with the Services may include changes to diet or hydration; adjustments to meal timing; introduction of new foods; physical activity such as walking or low-impact movement; emotional or psychological responses to stress-reduction practices including tapping and breathwork; and general lifestyle modifications.

These activities may not be suitable for all individuals and may result in discomfort, fatigue, dizziness, allergic reactions, changes in blood sugar, or other adverse effects.

You agree to seek medical advice before making any significant changes to your diet, exercise routine, supplements, or stress-management practices.

MasterLife does not monitor your health, symptoms, medical status, or physical responses to the Program. You are solely responsible for assessing your own wellbeing, pausing participation if needed, and seeking medical care where appropriate. MasterLife does not have a duty to warn, prevent, or foresee any adverse effects arising from your participation in the Services.

MasterLife is not responsible for interruptions caused by internet outages, software issues, platform downtime (including Zoom, WhatsApp, Facebook, or other third-party platforms), device failures, or other technological limitations that may affect your access to the Services.

To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless MasterLife and its officers, directors, employees, consultants, agents, successors and assigns from any loss, liability, claim, demand, damages, costs or expenses (including reasonable legal fees) arising out of or connected with:
(i) any breach by you of these Terms of Service;
(ii) your use of the Services or your account; or
(iii) your violation of any law or third-party rights.
This indemnity does not apply to any liability caused solely by MasterLife’s gross negligence or wilful misconduct.

MasterLife hereby disclaims all warranties, express, implied, statutory or otherwise, with respect to any general information or guidance provided by our Coaches or consultants, subject always to any non-excludable rights you may have under applicable law.

Limitation of Liability

To the maximum extent permitted by law, MasterLife and any party involved in creating, producing, or delivering the Services or Content shall not be liable to you for any punitive, special, incidental, consequential or indirect damages, including loss of data, goodwill, profits, programs, or the cost of substitute services, arising out of or relating to your use of, or inability to use, the Services or the Site, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, MasterLife disclaims all liability for the acts or omissions of other Clients or unauthorized users (including hackers). This limitation does not apply to liability caused solely by MasterLife’s gross negligence or wilful misconduct.

To the maximum extent permitted by law, MasterLife is not liable for any loss, interruption, error, data breach, or damage arising from third-party platforms or services used to deliver the Program, including Zoom, WhatsApp, Facebook, email providers, payment processors, or any hosting or software systems not operated by MasterLife.

To the maximum extent permitted by law, MasterLife is not liable for any decisions, actions, omissions, behaviours, or outcomes arising from your use of the Services, including dietary choices, exercise decisions, supplement use, or lifestyle changes undertaken by you.

Subject to your rights under the Australian Consumer Law or any similar law that cannot be excluded, MasterLife’s total aggregate liability to you for all claims arising out of or relating to the Services or the Site is limited to the total amount you have paid to MasterLife for the relevant Services.

Some jurisdictions do not allow limitations on certain types of damages. If these laws apply to you, some of the above limitations may not apply.

Violation of the Terms of Service

In addition to any other rights or remedies available to MasterLife, we may terminate or suspend your access to the Services or the Site, with or without notice where legally permitted, if we believe, in our sole discretion, that you have violated these Terms of Service.

MasterLife may also remove you from private community spaces, including Facebook groups, WhatsApp threads, or group coaching environments, if your conduct is inappropriate, harmful, disruptive, or violates these Terms. Removal from community spaces does not entitle you to a refund and does not limit MasterLife’s right to terminate or suspend your access to the Services where appropriate.

Termination of Services

MasterLife reserves the right, where legally permitted, to terminate or refuse access to the Services at any time for any reason, including circumstances where continuing the Client relationship may pose risk, conflict, or disruption. In such instances, where no breach has occurred, MasterLife will provide any refund required under the Australian Consumer Law.

You may terminate your subscription to our email newsletters or request closure of your MasterLife account at any time by emailing [email protected]. Cancelling an account or discontinuing your participation in a Program does not entitle you to a refund or compensation, except as required by the Australian Consumer Law.

If you are in breach of these Terms of Service, MasterLife may suspend or terminate your account or access to the Services at any time. In such circumstances, no refund or compensation will be provided, except where required by law.

If your access to the Services is terminated, suspended, or discontinued for any reason, you will lose access to Program materials, community spaces, session recordings, written summaries, digital downloads, and any other Client-only content, unless otherwise required by law.

Upon termination, discontinuation, or cancellation of your account or access to the Services, all provisions of these Terms of Service that by their nature should continue to operate will survive, including content rights and ownership provisions, disclaimers, assumption of risk and indemnity clauses, limitations of liability, and dispute resolution provisions.

Dispute resolution and Governing Law

Before commencing any legal action, you agree to first provide MasterLife with written notice of the dispute and allow MasterLife 30 days to attempt to resolve the matter in good faith. If the dispute is not resolved within this period, either party may proceed with formal legal action.

These Terms of Service are governed by the laws of New South Wales and the laws of Australia, to the extent permitted by law. You agree that any claim or legal proceeding arising out of or relating to your use of the Services or the Site must be brought exclusively in the courts of New South Wales, including the Supreme Court of New South Wales, or, for matters involving intellectual property, the Federal Court of Australia located in Sydney. All proceedings must be conducted in English.

If you access the Services from outside Australia, you are responsible for complying with any applicable local laws. Nothing in these Terms of Service affects any statutory rights or consumer guarantees that cannot be excluded under the laws of your jurisdiction.

To the maximum extent permitted by law, any claim or cause of action against MasterLife arising out of or relating to the Services must be commenced within one (1) year after the cause of action accrues, except where a longer period is required by the Australian Consumer Law or other applicable legislation. If not commenced within the permitted period, the claim is permanently barred.

If you have a dispute with other Clients, you release MasterLife from any claims, demands, or damages of any kind, known or unknown, arising out of or connected with such disputes, to the maximum extent permitted by law.

Personal information and privacy policies

MasterLife collects, uses and discloses Personal Information, including health information, in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, which is incorporated into these Terms of Service and available at www.masterlife.coach. Health information and other sensitive information are handled in accordance with the requirements for “sensitive information” under Australian privacy law.

By using the Site or Services, you consent to the collection, use and disclosure of your Personal Information (including your health information) as described in our Privacy Policy. Where required by law, we will seek your express consent before collecting sensitive information.

MasterLife does not sell, rent, or trade your Personal Information.

Some elements of the Services may be delivered through third-party platforms such as WhatsApp or Facebook. These platforms have their own privacy practices, and MasterLife is not responsible for their handling of your Personal Information.

We may update our Privacy Policy from time to time. Any updates will apply when posted on the Site or otherwise communicated to you. Changes to the Privacy Policy will not remove or limit any rights you have under the Privacy Act or other applicable laws.

Link to Third-Party Websites

Our Services may contain links to third-party websites, social media platforms, or other resources. These links are provided for your convenience only and do not form part of the Services. MasterLife does not endorse, control, or take responsibility for any third-party content, products, services, or information accessed through such links.

You acknowledge that you access third-party websites and resources at your own risk. You are responsible for reviewing the applicable terms, conditions, and privacy policies of any third-party websites you visit, including their policies regarding the collection, use and disclosure of Personal Information.

To the maximum extent permitted by law, MasterLife is not liable for any loss, damage, or harm arising from your use of third-party websites, platforms, or services, including any actions or omissions of those third parties.

Internet Service Provider Charges

You are responsible for all mobile, internet, cable, or other service provider charges incurred when accessing the Site or Services, including data usage, roaming charges, long-distance fees, and any equipment or line costs. MasterLife is not responsible or liable for any such charges.

Any dispute regarding your internet, mobile, or telecommunications services is strictly between you and your service provider.

You may receive text messages in connection with your use of the Site or Services. Standard messaging and data rates may apply, and you are responsible for all such charges.

MasterLife is not responsible for any automatic downloads, media files, or data usage generated by third-party platforms used to deliver parts of the Services, including WhatsApp or Facebook.

General Provisions

These Terms of Service, together with any policies or additional terms incorporated by reference, constitute the entire agreement between you and MasterLife regarding your use of the Site and Services. All prior written or oral agreements relating to your use of the Site or Services are superseded.

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

No failure or delay by MasterLife in exercising any right under these Terms of Service operates as a waiver of that right, nor does any single or partial exercise of any right preclude any further exercise of that right or any other right.

Our Communication With You

If you provide your express consent—such as by checking a box or selecting an option during registration—you agree to receive communications from MasterLife by email or through the Services regarding your account, program participation, and updates about the Site or Services.

You agree that any notices, agreements, disclosures, or other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

With your consent, we may also send newsletters, promotions, or information about third-party products or services. You may withdraw your consent at any time by using the unsubscribe link in our emails or by contacting us at [email protected].

MasterLife is not responsible for any emails or electronic communications that are filtered, blocked, or not received due to your email provider or device settings.

Your choice to opt out of marketing communications does not affect your obligations under these Terms of Service or your ability to use the Services.

Changes to this Terms of Service

We may update these Terms of Service from time to time to reflect changes in our practices, business operations, legal requirements, or for any other reason. Notification may be provided by email, through your MasterLife account, within Program platforms, or by posting a prominent notice on the Site. To the extent permitted by law, your continued use of the Site or Services after the updated Terms take effect constitutes acceptance of the updated Terms. You are responsible for reviewing the Terms regularly. Your continued access or use of the Site or Services constitutes your agreement to the then-current version of the Terms.
